Terms & Conditions

1. Introduction

These Terms and Conditions ("Terms") govern the provision of services by Balaz Enterprise Global Ltd ("the Company", "we", "us", "our") to you ("the Client", "you", "your"). By accepting a written quotation or instructing us to carry out works, you agree to be bound by these Terms. These Terms apply to all contracts for the supply of services including driveway installation, landscaping, garden design, brickwork, masonry, property maintenance, and property refurbishment.

2. Quotations and Acceptance

All quotations provided by the Company are valid for 30 days from the date of issue unless otherwise stated in writing. A quotation does not constitute a binding contract. A contract is formed only when the Client accepts the quotation in writing (including by email) and the Company confirms acceptance. The Company reserves the right to revise a quotation if the scope of works changes, unforeseen site conditions are discovered, or if the Client requests additional works not included in the original specification.

3. Payment Terms

Unless otherwise agreed in writing, the following payment schedule applies:

• A deposit of 30–40% of the total contract value is required upon acceptance of the quotation and before any works commence.
• Interim payments may be required for projects lasting more than two weeks, as agreed in the quotation.
• The final balance is due upon practical completion of the works.

Payments may be made by bank transfer, cheque, or other methods agreed in writing. The Company reserves the right to charge interest on overdue invoices at 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. The Company reserves the right to suspend or terminate works if payments are not made in accordance with these Terms.

4. Scope of Works

The Company will carry out the works as described in the written quotation. Any variations to the agreed scope of works must be agreed in writing before additional works are undertaken. The Client is responsible for ensuring that the Company has unobstructed access to the site and that all necessary permissions, planning consents, and building regulations approvals have been obtained prior to the commencement of works.

5. Materials

Unless otherwise stated in the quotation, the Company will supply all materials required for the works. Where specified materials are unavailable, the Company will offer suitable alternatives of equivalent or superior quality. All materials supplied by the Company remain the property of the Company until full payment has been received.

6. Workmanship Guarantee

The Company guarantees all workmanship for a period of 12 months from the date of practical completion. This guarantee covers defects arising from faulty workmanship but does not cover damage caused by fair wear and tear, misuse, neglect, accidental damage, or acts of nature. To make a claim, the Client must notify the Company in writing within the guarantee period.

7. Liability

The Company's total liability to the Client shall not exceed the total value of the contract. The Company shall not be liable for any indirect or consequential loss, loss of profit, or loss of business. Nothing in these Terms limits or excludes the Company's liability for death or personal injury caused by negligence, or fraud or fraudulent misrepresentation.

8. Insurance

The Company maintains Public Liability Insurance and Employers' Liability Insurance. Details of our insurance cover are available upon request.

9. Cancellation

If the Client wishes to cancel a contract after acceptance:

• Cancellation more than 14 days before the agreed start date: the deposit is non-refundable to cover administration and material ordering costs.
• Cancellation within 14 days of the agreed start date: the deposit is non-refundable and the Client may be liable for any materials already ordered or works already commenced.

10. Planning Permission and Building Regulations

It is the Client's responsibility to obtain any planning permission, listed building consent, or building regulations approval required for the works. The Company can advise on typical requirements but does not accept responsibility for ensuring compliance with planning or building regulations.

11. Disputes and Governing Law

In the event of a dispute, the parties agree to attempt to resolve the matter by good faith negotiation in the first instance. These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Data Protection
